Pennsylvania Duty of Care (Enacted 2000)

Pennsylvania home inspectors are not regulated under any specific state agency, but must be compliant with the provisions of Title 68, Chapter 75 when conducting business as a home inspector. Title 68 defines what constitutes a state recognized home inspector association, what conditions must be present in order for a home inspector to conduct a home inspection, what information must be disclosed to the consumer, and cites certain prohibited acts.

The following insurance requirements apply:

  • General liability insurance - $100,000 per occurrence and $500,000 aggregate

  • Errors and omissions insurance - $100,000 (per occurrence) and $500,000 (aggregate)

Pennsylvania Title 68, Chapter 75
